Terms of Service

Hello, and thanks for using the ARB Consumer Application (the “App”)! By accessing or using the App, you are agreeing to the Terms and Conditions as fully set forth at [website] (the “Full Terms”) and entering into a legally binding contract with UWM (you can read more about UWM in the Full Terms). This summary is provided solely for convenience. In the event there is any discrepancy between this short version and the Full Terms, the Full Terms control.

  1. CHANGES TO TERMS: UWM may periodically modify the Full Terms. The terms that apply at any given time are those at [website].
  2. OWNERSHIP: You do not own the App; however, you have a license to use it as described here.
    1. Risk: You use the App at your own risk, including the risk that you might see materials that are offensive, indecent, inaccurate, objectionable, or otherwise inappropriate.
    2. Eligibility: You must be 18 years or older to use the App or have permission from a parent or guardian. You may not access or use the App if UWM has previously prohibited you from using it.
    3. Availability and Updates: The App may be changed, interrupted, suspended or discontinued at any time without notice.
    4. UWM’s Role: UWM is not obligated to enforce these terms, but please let UWM know if another user violates the terms.
    5. User Account: You must create an account and provide certain information about yourself in order to use the App. You are responsible for keeping this information private and encouraged to create a username that does not personally identify you. You are responsible for everything that happens in connection with your account, so let UWM know immediately if there is any unauthorized use of your account. Your account can be closed at any time for any or no reason. When you create your account, you must provide complete and accurate information. You may not impersonate someone else, create or use an account for anyone other than yourself, use someone else’s email address, or create multiple accounts; however, you may create profiles for others if you have their consent and only use real information about them.
    6. Communications: UWM may communicate with you through the App itself or by e-mail.
    7. Feedback: If you send UWM any feedback, ideas, suggestions, documents or proposals, you will make sure that your feedback does not contain any confidential information about someone else. That said, your feedback will not necessarily be confidential. There are no guarantees that UWM will act on your feedback. If UWM does use your feedback, you ideas will belong to UWM.
    1. Definition: “Content” means anything you submit through the App (text, images, video, location, ratings, reviews, etc.)
    2. Responsibility: You alone are responsible for any Content you submit, and you assume any risks associated with submitting it. Once you submit Content, you cannot remove it. Unless you are a “Trained Rater”, you cannot imply that UWM endorsed your Content. If you submit Content that is fake, illegal, violates someone else’s rights, or is otherwise problematic, you will be liable.
    3. Ownership and Use: Once you submit Content, you no longer own it, and you cannot change it; UWM will own it and be able to use it in any manner it chooses (including changing it, removing it, etc.). Anyone can access the Content you submit.
    4. Other: Content does not necessarily reflect UWM’s opinion.
    5. Inappropriate Content: You will not submit Content that contains threats, defamation, libel, harassment, lewdness, hate speech, and other displays of bigotry, Content that is false, misleading, untruthful, or inaccurate, or Content containing the intellectual property of others. You will only submit Content that is relevant, appropriate, and based on first-hand knowledge.
    6. Privacy: You will not publicize other people’s private information without their consent including, but not limited to, their names and photos.
    7. Compensation: You will not pay someone or be paid to write to write/submit Content.
    8. Promotion: You will not use the App for any commercial reason, including promoting a business or event.
  5. APPLICABLE LAW: Wisconsin law and Wisconsin courts govern your use of the App; you agree to use the App in compliance with all applicable laws.
  6. INTELLECTUAL PROPERTY: You will not modify, copy, distribute, adapt, trade, sell, reverse engineer, attempt to gain unauthorized access to, or in any way exploit the App, any part of the App, its supporting network and systems, or any Content, including trying to scrape/mine it for data, using it to transmit viruses or other destructive items, using it to get information about other App users or their accounts, using it to create a searchable database of business reviews, attempting to interfere with its proper functioning, or trying to circumvent the its security features.
    1. Termination by User: To terminate this agreement, close your account and stop using the App.
    2. Termination by UWM: UWM may close your account, suspend your ability to use certain parts of the App, and/or ban you altogether from the App for any or no reason, and without notice or liability of any kind. This could prevent you from accessing your account, the App, the Content (including any submissions by you), or any other related information.
    3. Surviving Terms: Regardless of who terminates your account, any portion of this agreement that, by its nature, should continue to apply, will still apply.
    1. Information You Submit:
      1. To use the App, you must provide a username, e-mail address, and password. You may choose to submit other information. UWM may store information you submit to or through the App and use it to fulfill your requests, improve the App and your experience, comply with legal obligations, etc.
      2. Your posts, account profile (including your username), and other Content you post to the App are meant to be seen by the public. This Content may be displayed through the App and further distributed to a wider audience. Others may be able to identify you or associate you with your user account if you submit identifiable information.
    2. Information Collected: The App may use cookies and similar technology, so UWM may collect information about you and your App usage.
    3. Location: Parts of the App rely on location information. UWM and parties it works with may collect and use your location data, including your real-time location and location searches. This data will not personally identify you. You agree to its use as described in the Full Terms.
    4. Third Parties:
      1. UWM does not give personally identifiable information to third parties for their direct marketing purposes; however UWM may give out your information for other purposes.
      2. Parts of the App rely on third party providers. Your information may be shared with those parties (or they may obtain it directly from you). UWM is not responsible for any information you submit to third.
      3. UWM may disclose your information to others if it thinks doing so is necessary for legal reasons, or to protect you or a third party.
    5. Information Retention: If you terminate your account, UWM may continue to show some of your Content if it refers to you anonymously. UWM may also keep your information in its own systems indefinitely.
    6. Security: No electronic transmission or electronic storage is completely secure, so while UWM will strive to protect your personal information, its absolute security cannot be guaranteed.
  9. INDEMNIFICATION: If UWM gets sued based on your use of the App, you agree to compensate UWM for its losses, including attorneys’ fees, regardless of whether UWM consults you about the claim or the case. You cannot settle a case on behalf of UWM.
    1. UWM is not responsible for any loss you suffer from using the App; if a court determines otherwise, UWM’s liability is limited to $100.
    2. UWM makes no guarantees that the App will work properly or at all, or is safe and reliable. UWM makes no guaranties regarding third parties and is not liable for any loss you suffer as a result of their actions.
    3. If you have a problem with the App, your sole remedy is to stop using it.
